GlobalFront Policies

To maintain its ability to provide the best services to the majority of its clients and to keep its goodwill in the internet, GlobalFront has adopted several account policies. The policies are part of our service contract with our clients, and use of any or all services offered by GlobalFront from this website constitutes the user's agreement to abide by these policies in whole.

Compliance with Laws

All services offered by GlobalFront may be used for lawful purposes only. Storage, transmission, or presentation of any information, data or material in violation of any United States Federal, State, City or local law is prohibited. This includes, but is not limited to copyrighted material, material we judge to be threatening, racially defaming, or obscene, and material protected by trade secrets and other statutes.

Site and Server Content

Presentation and merchandising of, and or reference to, pornography and sex-related content, products or services are prohibited on all GlobalFront servers. This includes sites that may infer sexual content, or link to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to GlobalFront servers or any other server on the internet. Links to such materials are also prohibited. Other examples of unacceptable content or links include pirated software, "hacker" programs or archives of "warez sites" or any kinds of software or shareware like Illegal audio/video (mp3, illegal recorded samples). We will be the sole arbiter as to what constitutes a violation of this provision.

IRC, Chat Rooms, and CGI Scripts

We currently do not allow IRC or IRC bots to be operated on our servers. These tend to have large load on system resources. There are third party providers that offer free (advertisers sponsored) and paid chat rooms and would provide you with html codes that you could paste in your web pages to include chat functionalities. We recommend you sign up with them if you would need chat services for your accounts.

We offer you your own cgi-bin in virtual hosting accounts and virtual servers.  You are free to use any CGI script you like, as long as the script you select does not use excessive system resources.  We reserve the right to disable any script that affects normal server performance.  We may allow programs to run continually in the background (cron jobs, for instance), but these are considered on an individual basis and an extra charge is assessed based on system resources used and operational maintenance needed for these.

Email Abuse, Spam and Mail Filtering

GlobalFront servers may not be the source, intermediary, or destination address involved in the transmission or storage of bulk unsolicited e-mail (spam), flames, or mail bombs. If we were to deal with spamming complaints, it would compromise our ability to provide quality services to our customers. Specifically, none of the following will be tolerated:

  • The sending of any unsolicited email mentioning an email address for any domain hosted by GlobalFront.
  • The sending of any unsolicited email mentioning a domain hosted by GlobalFront.
  • The sending of any unsolicited email mentioning an IP address hosted by the GlobalFront.
  • The posting of references to adult content using GlobalFront services.
  • The posting of advertisements on IRC, ICQ, or any other public chat system.
  • The posting of any unsolicited message in any inappropriate newsgroup.
  • The storage, sale or presentation of bulk-email software from any GlobalFront server.

GlobalFront reserves the the right to immediately deactivate and cancel without refund any domain, hosting account, or email account found to be in violation of the above guidelines. Also, the User will be fined $200.00 minimum for each instance of spamming. Additionally, the User may be liable for any amount justified to compensate for consequential costs incurred by GlobalFront as a result of spamming. GlobalFront will be the sole arbiter as to what constitutes a violation of this provision. If any user is expecting to send or receive excessive volume of emails (more than 1000 messages a day per user or more than 3000 messages a day per domain), the User should contact GlobalFront in advance. Under such scenarios, GlobalFront reserves the right to advise the User to upgrade the User's account and/or to relocate the account on to a server with more resources with reasonable fees determined by GlobalFront's own estimation and discretion. If excessive email usage is observed for any User's regular email account or domain that has not been pre-authorized by GlobalFront for excessive email usage, during non-emergency situation GlobalFront will notify the User and advise the User to take corrective actions. However, if excessive email usage by a specific User or a specific domain continues to the point when it can actually or potentially cause disruption of normal services for other users or domains, GlobalFront reserves the right to deactivate, delete and/or cancel the User's account(s) or domain(s) without prior notification to the User.

GlobalFront uses spam reduction solutions deemed by GlobalFront to be appropriate for its server and service environments, based on the judgement of and feedback from its own employees, contractors, agents and the majority its clients. Depending on the User's account type, such solutions may include technologies (a) to filter or reject incoming spams; (b) to block spammer email address(es), domain name(s), IP(s) and/or IP block(s) from being able to deliver email messages to GlobalFront servers; and (c) to filter or block emails containing spamvertised domains or URLs. While doing so, GlobalFront may use any standard technology, including but not limited to, sendmail reject lists, sendmail queries to DNSBL lists, and procmail filters. By using or signing up for GlobalFront's services, the User approves GlobalFront's usage of any or all of the above technologies for spam reduction for the User's domain(s), hosting account(s), and/or email account(s). However, the User also agrees that GlobalFront may not be held responsible for failure to stop incoming spam(s), worm(s) and/or virus(es) coming to the User's domain(s), hosting account(s), and/or email account(s) under any circumstances.

GWCP User Agreement

If you are using our proprietary software Global Web Control Panel with a qualified virtual or dedicated server or virtual hosting account, then you are subject to Global Web Control Panel User Agreement which is incorporated into GlobalFront service policies by reference.

GDCP User Agreement

If you are using our proprietary software Global Domain Control Panel for managing  URL, IP, email, meta tag, DNS or MX settings for any domain, then you are subject to Global Domain Control Panel User Agreement which is incorporated into GlobalFront service policies by reference.

Domain Registration and Dispute Policies

GlobalFront is partnered with multiple ICANN accredited registrars to provide domain registration services for several top-level domains (TLDs). ICANN Uniform Domain Dispute Resolution Policies apply to registration and use of any ICANN administered domain name (including, but not limited to, all .com, .net, .org, .edu, .biz, .info TLDs). If you register your domain name through GlobalFront, then you agree that GlobalFront will register your domain with one of the ICANN accredited registrars GlobalFront is partnered with, and your registration of the domain name will be subject to the policies of GlobalFront as well as the registrar your domain name is registered with. A non-exclusive list of links to certain major registrar policies have been incorporated in our policies overview page.  As a Registrant of a domain, you have the following responsibilities:  (1) You must comply with the terms and conditions posted by your Registrar, including applicable policies from your Registrar, the Registry and ICANN.  (2) You must review your Registrar’s current Registration Agreement, along with any updates.  (3) You will assume sole responsibility for the registration and use of your domain name. (4) You must provide accurate information for publication in directories such as WHOIS, and promptly update this to reflect any changes.  (5) You must respond to inquiries from your Registrar within fifteen (15) days, and keep your Registrar account data current. If you choose to have your domain name registration renew automatically, you must also keep your payment information current.

Due to ICANN policy changes at the beginning of 2014, upon your domain registration, a verification e-mail will be sent to the registrant email address.  The registrant would need to click the verification link in the e-mail message within 15 days to avoid suspension of domain(s).  If you do not receive a verification message within 24 hours following domain registration, please contact us to have us re-send the verification message. As an alternative, you could provide updated contact information by clicking the Registrant Update link in our Domain Support Services site.  Also, any changes in Registrant name or email address field will need to be validated through verification link in a follow-up verification email message.  You understand that GlobalFront will not be liable for any suspension of your domain name(s) or associated services by the registrar due to your failure to complete the verification using the proper link in the verification email message.  In addition to the original email verification, you will also receive one additional contact verification message per year.  No action would be needed for the additional verification messages if your contact address has not changed since the original registration of the domain. In case of contact information changes, you agree to update your contact information by visiting GlobalFront's Domain Support Services site.

GlobalFront also welcomes country-code domain name extensions on its servers, and provides name-server and registration information to help the User complete domain registration in foreign countries (countries or territories outside USA). However, the User is responsible for complying with all laws in effect in the User's territory and in effect by the appropriate foreign registry.

If your domain was registered through GlobalFront, then we require that we receive the registration renewal fee from you at least 3 days in advance of the due date so that we have enough time to process your payment and pay the appropriate registrar for renewal of the domain. GlobalFront does not guarantee renewal of any domain for which GlobalFront has not received registration renewal payment at least 3 days before the expiration date. GlobalFront reserves the right to disable, leave for expiration of, redirect, reassign ownership of, assume ownership of, and/or renew, the User's domain(s) at GlobalFront's own discretion if (a) GlobalFront does not receive registration or renewal payment on time as specified on this page, (b) if the payment information submitted to GlobalFront by the User appears to be invalid, (c) if the payment charge is denied by the User's credit card bank on the day of the payment or on the next business day, (d) if there is a charge-back for the payment amount anytime after the payment is received, (e) if the payment check is bounced anytime after the payment is received.

If your domain was registered through GlobalFront along with the purchase of an associated hosting account from GlobalFront with a monthly recurring payment term, then GlobalFront will email you a renewal invoice for the domain before the expiration of the domain service term. It would be the User's responsibility to respond to GlobalFront's renewal notice by either (a) making a payment to renew the domain before the payment due date, or (b) notifying GlobalFront the intention to cancel domain and hosting service accounts. Unless GlobalFront receives a response regarding renewal or cancellation of the domain/hosting accounts from the User before the payment due date, GlobalFront may decide, at its own discretion, to either (a) renew the domain and charge the renewal fee to the User's credit card, or (b) let the domain expire and cancel the associated hosting account at the end of the current term.

The User agrees that if GlobalFront does not receive renewal payment for a domain before the scheduled expiration date for the domain, the User's rights associated with the domain name will end effective its scheduled expiration date. Upon non-renewal of the domain prior to its scheduled expiration date, the domain will be deactivated or redirected by the registrar and/or GlobalFront effective or following the scheduled expiration date for the domain. The User agrees that on or after the scheduled expiration date for a domain, if the User wishes to renew and/or reactivate the domain within 30 days, the User must pay to GlobalFront the regular renewal fee plus a non-refundable $250.00 redemption fee. The User understands that GlobalFront has no obligation to renew an expired domain without the redemption fee. However, under certain circumstances when the registrar of the domain has not yet charged GlobalFront a redemption fee to renew an expired domain, GlobalFront may, at its own discretion but without any binding obligation to the User, decide to allow the User to renew the expired domain for regular renewal fee plus a non-refundable $10.00 reactivation fee. The User further agrees that GlobalFront won't be responsible for non-renewal or renewal of such a domain.

GlobalFront reserves the right to reassign or update registrar, registrant, contact(s) or nameserver(s) associated with the User's domain(s) at GlobalFront's own discretion if (a) the registrant, admin, billing and/or technical contact email address(es) associated with a domain registration record appear to be non-working, and/or (b) GlobalFront does not receive proper and timely verification response from the registrant, admin, billing and/or technical contacts of the domain(s) when such response is requested by GlobalFront for processing of registrar transfer, registrant transfer, contact update, nameserver update, and/or dispute resolution requests for the domain(s). The User agrees that GlobalFront will not be liable for loss of the User's domain name or domain name use resulting from GlobalFront and/or the registrar's deleting, disabling, selling, reassigning or assuming ownership of, or releasing, the User's domain name due to the User's non-payment of registration or renewal fees on time, and/or the User's failure in proper and timely communication regarding registration or renewal issues. The User agrees that a domain name cannot be transferred to another registrar during the initial 60-day period following registration, transfer or renewal of the domain and during the 14-day period prior to the expiration date of the domain. The User may change registrar at any other time using ICANN approved policies and procedures, provided the domain is in good payment standing.

If your domain was registered or renewed through a registrar, ISP or web host other than GlobalFront, then you are responsible for all registration and renewal fees that are due to the registrar of your domain. If you are using GlobalFront's DNS, forwarding, hosting, design or other services for such a domain, then you agree that GlobalFront is not responsible for advising or not advising you on expiration date for the domain. For all such domains, you agree to contact your domain's registrar, ISP or web host directly regarding registration, renewal or dispute resolution for the domain(s).

Web Traffic

Specific traffic guidelines for servers hosted by GlobalFront are outlined in feature description and explanation section for each server. It is the User's responsibility to monitor the traffic. We are pleased to offer unlimited web page traffic to standard and reseller servers. However, to maintain the quality and integrity of our services for the majority of our customers, GlobalFront sets traffic limitations for the following types of sites hosted in standard servers:

  • Sites housing multiple directories with unrelated information and or sites reselling web space under their own account.
  • Multiple hosts resolving at an IP or domain name that we provide.
  • Sites with banners, graphics or CGI-scripts running from their domain used on other domains.
  • Sites with shareware, sound, video, image and multimedia archives or galleries (including but not limited to those with abundance of gif, jpg, avi, exe, zip, and tar files).
  • Mirror sites for other websites hosted on other domains.
  • Sites offering many software or files for download. This is any site where 20% or more of the monthly traffic is from file downloads. 
  • Sites using more than 20% of system resources.

Due to the unique resource characteristics and traffic patterns associated with these sites, we allow a maximum of 200 MB of traffic in a given DAY for any standard server hosting sites of the above nature. This is about 30 times what the average User of standard server needs. Standard servers exceeding this limit is assessed our affordable fee of US $10.00 per 100 megabytes of web traffic. Also, GlobalFront will be the sole arbiter as to what constitutes a violation of this provision, and reserves the right to advise any domain exceeding traffic guidelines to switch to a higher-grade servers.

Billing and Payments

Your billing period begins when we deliver our service to you for your initial order. This delivery follows after we receive and process your payment for any specific service. After that, payment is due every month, every three months, every six months, every year, or every other year on the day your initial service began, depending on the payment term you originally selected while placing the order.

For all terms except for the monthly payment term, we send you an invoice about 14 to 21 days prior to the end of your current contract period. For monthly payment term, you are responsible for payment every month on the day your initial service began. Monthly payment plan is only available when you use credit card for your payment method, and give us the permission to charge your credit card on a recurring basis.

GlobalFront accepts payments in US currency made with credit cards and checks, sent online, by fax, and by mail. For all payments, it is the User's responsibility that GlobalFront receives the payment on time. GlobalFront cannot process an order or renew an existing account without receiving the proper amount due for the appropriate setup, registration, renewal, reactivation or other charges. Also, GlobalFront is not responsible for checks delayed or lost in the mail, nor for mails or checks addressed or delivered to wrong address(es).

For domain services, GlobalFront's domain registration renewal payment terms are specified in the "Domain Registration and Dispute Policies" section of this page. 

For hosting services, an User's account is in default if payment is not received within the due date mentioned in the renewal invoice from GlobalFront. If the hosting renewal payment is not received within 7 days after the payment due date, services for the account will be canceled without further notification to the user. If the User's website has been deactivated due to non-renewal before the due date, and the User would still like to renew services for the account, the User could do so by making a payment for the amount overdue plus an additional $10.00 service reactivation fee. (Under some scenarios, if the User's account(s) was/were in good payment status with GlobalFront prior to such deactivation, GlobalFront may renew hosting services without requiring the reactivation fee). However, such renewals would be retroactively effective from the expiration date, so the User won't get any credit for the days when your services stayed deactivated for non-renewal on time.  

For any service, the User's account or domain will be deemed to be in default, if payment for the account is overdue, the User's check is bounced, and/or if the User's credit card payment is failed. For bounced checks, the User would also be assessed a $30.00 "returned check" fee. Accounts unpaid 3 days after due date may have their service interrupted or terminated by GlobalFront. Such interruption or termination does not relieve the User from the obligation to pay any unpaid charges. Only a prior written and signed notice of intent to terminate your service relieves you of your obligation to pay the monthly account charges.  If the User defaults, the User agrees to pay GlobalFront any reasonable expenses, including attorney and collection agency fees, incurred by GlobalFront in enforcing its rights under the terms, conditions, and policies outlined herein. 

Terms and Termination

Use of any service provided by GlobalFront constitutes an agreement between GlobalFront and the User of the service. This agreement starts when GlobalFront sends an email confirmation following the receipt of the User's request for any initial service, and remains in full effect until termination. The service can be terminated by either party with at least a 7-day advance written notice of intent of termination by either party. However, if the policies, terms, and conditions specified in this agreement is violated by the User, GlobalFront reserves the right to terminate the account without advance notice.

Unless otherwise specified or terminated in advance, this agreement shall automatically be renewed for one month or for successive term periods as the original one specified in the service order form by the User. All terms and conditions of this agreement shall be in full force and effect during the original and renewal periods specified in service order and subsequent written notice, when applicable. Unless notice of cancellation is received by GlobalFront from the User in advance, the User will be responsible for the payment due for the next renewal period. When the User cancels the service, the User remains responsible for any outstanding payment due and payable at the time of cancellation.

User has 30 days from date of account setup to be eligible for a refund. If User requests a refund in this time period, User will receive a refund in the amount of their initial monthly payment(s). User will not receive a refund for any setup fees. If you had made a payment for a term longer than a month and cancel at least 10 days in advance before the end of the term, we will refund you the pro-rata share of your payment for unused months. However, the User will not receive a refund for any other reason, including but not limited to late cancellation, unused time before cancellation, or account termination for violation of policies.

GlobalFront reserves the right to terminate this agreement without refund, delete the website or contents thereof from its servers, deactivate any account, impose monetary fines, and/or seek other legal measures allowed by law against the User, immediately upon the occurrence of any of the following events:

  • The User's non-payment of any charges due for GlobalFront services.
  • Violation of any term or condition of this agreement by the User.
  • Any attempt by the User, or its designated parties, to undermine or cause harm to any server hosted by GlobalFront or its clients, irrespective of whether the attempt was effective or not.
  • Beginning of any lawsuit or proceeding against the User arising from or relating to its use of GlobalFront services, whether or not such suit names GlobalFront as a party or seeks any recovery from GlobalFront.

The User acknowledges and agrees that GlobalFront has the right to delete all contents, including website contents, data, scripts, programs, files, configurations or other information that is stored in the User's account if the User's account with GlobalFront is terminated, by either GlobalFront or the User, under conditions specified in this agreement. 

IP Addresses

GlobalFront as a web hosting company is required to follow the policies of ARIN regarding allocation of IP addresses to its servers and hosting accounts. The User agrees that ARIN holds the ultimate authority on use and allocation of IP addresses in North America, and that GlobalFront may change, reassign, remove and/or withdraw any IP address(es) for its own or client servers and hosting accounts at GlobalFront's own discretion to comply with ARIN policy changes or to respond to system, network and security requirements.

Network Security and Software Support

The User agrees to take all steps reasonable, necessary, and prudent to protect User's login id and password, and agrees not to allow others to cause any harm to any server or customer of GlobalFront. The User acknowledges that GlobalFront does not provide technical support for any software and/or script that the User installs, other than advise on name changes for variables in conflict with existing names used in our system.

Relationship between Parties and Indemnification

Nothing contained in our website shall be considered to create or imply a relationship between GlobalFront and its Users including its resellers, referrers, fundraisers and independent distributors, in the nature of a partnership, joint venture, editor/publisher or otherwise, unless prior written and signed agreement was reached confirming such relationships. The User acknowledges and agrees that GlobalFront has no interaction with the content of the User's websites and their non-internet advertising and merchandising, except as necessary to host the User's websites, or to provide references to their external sites and addresses, where applicable. The User agrees to indemnify and hold GlobalFront and its employees and agents harmless from any claim, lawsuit, charge, or expense for damages to the User or to any third party, including reasonable attorney fees and costs of defense, for any matter arising from or relating to the User's use of any services offered by GlobalFront.

Compliance to GlobalFront Policies

If any terms or conditions are failed to be followed by the User, it may result in grounds for immediate account deactivation by GlobalFront. All GlobalFront Users including resellers, referrers, fundraisers, independent distributors and freesite plan participators must agree in whole to these policies. GlobalFront reserves the right to revise its policies at any time without notification, and to refuse service to anyone or to deactivate any account at GlobalFront's sole discretion.

Disclaimer

GlobalFront can not be held responsible for any damages you or your business may suffer from use of any of the services offered in this site. GLOBALFRONT HEREBY DISCLAIMS ANY WARRANTY, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, WITH REGARD TO SERVICES PROVIDED BY US. IN NO EVENT SHALL GLOBALFRONT, ITS EMPLOYEES AND AGENTS, OR ITS ASSOCIATES BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (including, but not limited to, damages for loss of profits, loss of information or data, or any other loss, from delays, non-deliveries, wrong delivery, or interruption of service by GlobalFront and its employees and agents), ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICES OFFERED OR PROVIDED BY GLOBALFRONT. In the event that GlobalFront fails to provide any service promised in this website, GlobalFront's, its employees' and agents', or its associates' entire liability and the User's exclusive remedy shall be a return by GlobalFront to the User, of payment for current month's services, pro-rated if applicable, and of advance payments for future terms, received by GlobalFront from the User for the service concerned, unless specifically written otherwise in the service agreement.

Miscellaneous

This agreement along with the policies, terms and conditions outlined here, will be governed by the laws of the United States of America, State of Minnesota, Ramsey County and City of Saint Paul. The User agrees that while the User may purchase and use GlobalFront's services from any country with which US Government does not have a current trade embargo or other business restriction(s), if and when Government policy changes warrant it, GlobalFront reserves the rights to discontinue services to the User, with or without notice, and without any penalty for such discontinuation required for compliance with US Government laws and policies.  Also, while the User can purchase and use GlobalFront's services irrespective of the primary language of the User, the User understands and agrees that any legal communication sent to GlobalFront must be using English as the primary language of communication. The User agrees and understands that GlobalFront is not obligated to comprehend, or respond to, any legal communication sent to GlobalFront unless the communication is using English as the primary language.  Any communication sent by GlobalFront or sent on behalf of GlobalFront to the User will use English as the primary language of communication.

The User agrees that if any provision of this agreement shall be deemed invalid or for any reason unenforceable, then that provision shall be considered severed from the rest of the provisions of this agreement, and shall not affect the validity or enforceability of the remaining provisions of this agreement.

The policies, terms and conditions outlined in this page and linked directly from this page, constitute the whole agreement between GlobalFront and its Users and Associates, and no one else, including but not limited to, the Users and Associates (resellers, referrers, fundraisers and independent distributors) of GlobalFront services, reserve any right to modify, mis-present, misrepresent, or misinterpret any of the policies outlined in this page. Also, this agreement is the complete statement of GlobalFront's contract with its Users, and supersedes any proposal or prior communications between GlobalFront and the Users.
